General legal information

Foreign individuals can buy real estate on the territory of Bulgaria. The purchase of apartments is allowed both to foreign physical and foreign legal entities. When buying a villa, you should consider some of the features of Bulgarian legislation. In order to buy land it is necessary to register a legal entity with foreign participation.

In Bulgaria, the registration of a real estate purchase transaction is carried out only by a notary in your personal presence or in the presence of your authorized representative acting on the basis of a power of attorney. With a view to registering a transaction, a foreign individual must provide a valid foreign passport, and when buying real estate by a legal entity - the company's founding documents.

The procedure will take no more than 3 working days. After the signing of the notarial deed by the seller and the buyer, the document is submitted by the notary for the verification of signatures to the district court. The future owner of real estate must pay taxes and fees for notarization of real estate, which is about 3% of the value of the object and include a local tax in the budget, notary fees, a fee for making entries in the state register. Taxes are paid for the sale price of the property, indicated in the notarial deed, or on the tax assessment of the value of the object - depending on which the tenancy is higher. In the end, you will receive a Notary Act, which confirms your ownership of (the owner) the property you are buying.
The owner of real estate in Bulgaria is obliged to pay annually the tax on immovable property and communal taxes (payment for household waste, water and electricity consumption).
Taxes in Bulgaria, which the owner of real estate is obliged to pay annually:

 

1. Real Estate Tax:
All real estate is levied, except for forests and cultivated agricultural land. Owners of property within two months from the date of purchase - purchase or completion of construction - are required to declare it before the tax service. The declaration gives a detailed description of the property: the year of construction, construction materials, structural features, area, number of storeys, purchase price, etc.

The taxable base for firms is the book value of real estate, for individuals - the price of real estate, determined by the territorial tax service. The tax rate is the same for individuals and legal entities and is 0.15%. The tax on the basic accommodation of private individuals, is reduced by 50%. The main is recognized housing, where the owner and members of his family live most of the year. It is paid in four equal installments until March 31, June 30, September 30 and November 30. Firms and individuals paying the tax once until March 31 receive a discount of 5% of the tax amount.

 

2. Cost for cleaning household waste:
The amount of payment is established by local authorities. For residential buildings - in proportion to the book value or depending on the amount of waste. For non-residential buildings - depending on the type and number of containers for collecting waste. In the case when it is impossible to determine the type and number of containers for each individual building, the tariff is established in proportion to the book value of the building. It is paid simultaneously with the tax on immovable property.

Private housing is taxed based on its value, established for real estate tax. Every year until the end of January, each tax owner sends a notice on the amount of real estate tax and the cost of household waste. The calculations contained in it allow the taxpayer to verify the reliability of the data and the correctness of the amount. Here are the tariffs for some cities: Varna - 0,15%, Plovdiv - 0,21%, Burgas - 0,25%, Sofia - 0,325%, Nessebar - 0,15%.

3. Utilities:

Monthly consumed water and electricity are paid according to meter readings.


• Electricity per 1 kWh (VAT included): daily rate: 0.17628 lv. / kWh, night rate (22: 00-6: 00) - 0,11730 lev.


• Water per 1 cubic meter - 1,20 lev. (VAT included)

 

 4. Dachshund maintenance and management of real estate:
